These Terms of Service (“Terms”) govern your access to and use of laparoscopic.tv (the “Service”), operated by the operator of laparoscopic.tv (“we”, “us”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service is
laparoscopic.tv is an educational video platform for the surgical community. It lets registered users upload, watch, and discuss laparoscopic and other surgical videos, and offers AI-assisted features — such as transcription, video analysis, semantic search, and conversational answers (“Ask AI”) — powered by our video-intelligence provider, Coniviso.
The Service is intended for medical professionals, trainees, and students of the health professions only. It is an educational resource, not a source of medical advice — see our Medical Disclaimer, which forms part of these Terms.
2. Eligibility and your account
- You must be at least 18 years old.
- You must provide accurate registration information and keep your credentials confidential. You are responsible for all activity under your account.
- We may suspend or terminate accounts that violate these Terms, abuse the Service, or create risk for us, other users, or third parties.
- You may delete your account at any time from your profile page. Deletion removes your account and associated content as described in the Privacy Policy.
3. Your content
You retain ownership of the videos, comments, and other material you submit (“User Content”). By submitting User Content you grant us a worldwide, non-exclusive, royalty-free license to host, store, transcode, reproduce, adapt (for example, generating thumbnails, transcripts, captions, and AI-derived analysis), and — for content you choose to publish — publicly display and distribute it through the Service. This license exists solely to operate, improve, and promote the Service and ends when your content is deleted, except for copies kept in routine backups for a limited period or as required by law.
Uploaded videos are private by default. Publishing a video submits it to moderator review; during review it may be made temporarily viewable to moderators. Approved videos become visible to the community. Moderators may reject, unpublish, or remove content at their discretion.
4. Content standards — patient privacy comes first
By uploading a video you represent and warrant that:
- you own the footage or have all rights and permissions needed to upload and publish it;
- any required patient consent for recording and educational use was obtained in accordance with applicable law and your institution’s policies;
- the content is fully de-identified: no patient names, faces, dates of birth, medical record numbers, or any other information that could identify a patient may appear in the video, its audio, title, description, or metadata;
- the content serves a genuine educational or professional purpose; and
- the content does not violate any law or the rights of any third party.
Attempting to re-identify a patient from any content on the Service is strictly prohibited and grounds for immediate termination. To report content that appears to contain identifiable patient information, see Copyright & Takedown.
5. Community rules
When using discussions, comments, or any interactive feature, you must not:
- post unlawful, harassing, defamatory, or deliberately misleading material;
- post spam, advertising, or promotional material without our consent;
- impersonate any person or misrepresent your credentials or affiliation;
- upload malware or attempt to compromise the Service or other users;
- scrape, bulk-download, or systematically extract content or data from the Service, or circumvent access controls, visibility settings, or usage quotas;
- reverse engineer the Service except where permitted by law.
6. AI features
Transcripts, analyses, search results, and Ask AI answers are generated automatically by machine-learning systems. They may be incomplete, out of date, or wrong, and are provided for convenience only. They are not a substitute for your professional judgment, and we make no warranty as to their accuracy. AI usage may be subject to plan quotas (for example, AI minutes and storage limits) shown on the pricing page.
7. Paid plans and billing
- Paid subscriptions and top-up packs are processed by Paddle, our merchant of record. Your purchase is also subject to Paddle’s buyer terms.
- Subscriptions renew automatically until cancelled. You can cancel, change plans, and view invoices from your profile; cancellation takes effect at the end of the current billing period.
- Prices, plan features, and quotas are described on the pricing page and may change; changes apply from your next billing period after notice.
- Refunds are handled in accordance with Paddle’s policy and your statutory rights, including EU consumer withdrawal rights where applicable.
8. Our intellectual property
The Service — including its software, design, logos, and all content we provide (other than User Content) — is owned by us or our licensors and protected by intellectual-property laws. These Terms do not grant you any right to use our trademarks or branding. If you send us feedback or suggestions, we may use them without obligation to you.
9. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that content will be preserved without loss — keep your own copies of anything you upload. Nothing on the Service constitutes medical advice; see the Medical Disclaimer.
10. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for all claims relating to the Service is limited to the greater of (a) the amounts you paid us in the 12 months before the claim and (b) EUR 50. Nothing in these Terms excludes liability that cannot be excluded by law, including liability for wilful misconduct or gross negligence, or your statutory consumer rights.
11. Indemnity
You will indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your User Content — including any claim that it contains identifiable patient information or was recorded or shared without the required consents — or from your breach of these Terms.
12. Changes to the Service and these Terms
We may modify or discontinue features at any time. We may update these Terms; if a change is material we will give reasonable notice (for example, by email or an in-app notice). Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of Italy, without prejudice to any mandatory consumer-protection rules of your country of residence. Disputes will be brought before the competent courts of Italy, unless mandatory law provides otherwise.
